What is the CCPA and how can I prepare?

In late June of 2018, California passed what is arguably the most expansive privacy law in U.S. history. The California Consumer Privacy Act, or CCPA, comes into effect on January 1st, 2020 and it brings along a new wave of privacy regulations for businesses to navigate. This new law will impact many companies doing business in California, regardless of the location of their headquarters or physical operations.

What is the CCPA?

At its core, the CCPA will allow consumers to know what personal data is being collected about them and request a business to delete that personal information. Consumers will also receive the right to say no to the sale of their personal data and to know whether their personal data is sold and to whom.

The law also specifies that businesses need to make the option to opt-out of data sharing clearly visible on the homepage of their websites. Companies will also need to designate methods for data access requests, including, at a minimum, a toll-free telephone number.

How Americaneagle.com can help

The passing of the CCPA has spurred a sea of change for companies around the world and thousands have made comprehensive changes to their data policies. On January 1st, consumers will gain control over their personal data. The challenge for companies now is figuring out the best way to locate, present, and delete that data for consumers who ask for it.

Americaneagle.com offers a range of data services to help you prepare for this new law:

1. Perform an audit of your site

Do you know exactly what information is being collected on your site and where it is being stored? If not, an audit of your site can be a great place to start as the CCPA compliance deadline approaches. Americaneagle.com can assess and audit all of your database collection systems in addition to any 3rd party components and add-ons (HubSpot, Pixel Tracking, etc.) that may be collecting customer information on your behalf.

2. Find a seamless way to manage CCPA requests

Data can be collected in multiple ways and if your company is presented with a CCPA-related request, it will be important to have a simple method of locating and purging consumer data. Americaneagle.com offers a custom suite of tools to help you search for and manage your consumers’ personal data when those requests come in.

3. Legal partner recommendations

The ins and outs of the CCPA can be difficult to manage when working solo. Consider working with a legal partner, like Nixon Peabody LLP, to learn more about the law and prepare a comprehensive privacy policy for your organization.
